Social Insurance Fund against accidents at work and occupational diseases that caused disability
Insurance against accidents at work and occupational diseases that caused disability is exercised by Social Insurance Fund against accidents at work and occupational diseases that caused disability (hereinafter referred to as –Fund) that is nonprofit self-governing organization acting on the grounds of Statute approved by its Board. Social Insurance Fund against accidents is a legal entity. Fund’s activity is governed by the Fundamentals of legislation on Obligatory State Social Insurance, the Law of Ukraine on Obligatory State Social Insurance against accidents at work and occupational diseases that caused disability, Labour Code of Ukraine, the Law of Ukraine on Labour Protection and other legal documents.
The governing of the Fund is exercised on an equal base of state, representatives of insured persons and of employers. Board of the Fund and the Executive Directorate exercise direct governing of the Fund.
The Board consists of the representatives of state, of insured persons and of employers. The Board of Fund holds its meetings according to approved plan but not rarely than twice per year. Decision of the Board of the Fund accepted within its competence is obligatory for the fulfillment by all the insurers and insured persons.
Executive Directorate of the Social Insurance Fund against accidents is a permanent and operative executive body of Fund’s Board. Executive Directorate exercises material support of the Supervisory Board’s and of Fund’s Board activity. Working bodies of the Fund’s Executive Directorate are its departments in Autonomous Republic of Crimea, oblasts, Kyiv and Sevastopol cities, departments in regions and cities of regional sense. Working bodies of the Fund’s Executive Directorate are legal entities.
The supervision over the Fund’s activity is carried out by the Supervisory Board. Supervisory Board consists of 15 persons; representatives of state, insured persons and employers are in equal quantity. Members of Supervisory Board act on a voluntary basis. The meetings of Supervisory Board are hold not rarely than once per half a year.
The sources of property’s forming that is in Fund’s ownership are property, acquired at the expense of assets that come up before the Fund and also property transferred to its possession by other owners.
Financing of the Social Insurance Fund against accidents is exercised at the expense of:
- employers’ contributions: for enterprises – with a glance of gross expenses of production; for government-financed establishments and organizations – from appropriations assigned for their maintenance and endowment;
- capitalized payments that came up in case of insurers’ liquidation in the order determined by the Cabinet of Ministers of Ukraine;
- profit, gained from temporary free Fund’s assets on deposit accounts;
- assets received from exaction of a penalties and fine from insurers according to the Law of Ukraine on Obligatory State Social Insurance against accidents at work and occupational diseases that caused disability, penalties from workers guilty in violation of the legal acts’ requirements on labour protection as well as some other administrative recoveries such as penalties from enterprises’, establishments’, organizations’ officials and persons who use labour force envisaged in the Code of Ukraine on Administrative delinquencies;
- optional contributions and other earnings the receipt of which does not contradict the legislation.
Procurements of goods, works and services for assets of social insurance against accidents at work and occupational diseases that caused disability is exercised according to the requirements and procedures laid down in the Law of Ukraine on Procurements of goods, works and services for public funds.
Social Insurance Fund against accidents according to the legislation is responsible for damage injured for insured persons as a result of non-fulfillment, of late and undue execution of insurance conditions laid down by legislation.
